Guidelines for Using Net.Orange Trademarks

Additional Trademark Usage Information for Third Parties

You may mention the names of Net.Orange offerings when describing their compatibility with your own programs or applications. But as an Net.Orange partner or other third party, you may not include the name "Net.Orange," a logo of Net.Orange, a trademark of Net.Orange, the name of an Net.Orange offering or similar variations into your own product or service name, company name, domain name, or any of your logos.

When referring to product compatibility, you must make a clear distinction between your products or services and those of Net.Orange. The name of your offering and the name of the Net.Orange offering must be clearly distinguished from one another either visually or by the wording. You can accomplish this goal in a variety of ways in running text and in headlines, signs, or other materials. Also, when referring to your product's compatibility with an Net.Orange offering, please mention your company name in addition to your product name.

When expressing compatibility, you must not allow your offering's name to appear to include an Net.Orange trademark. For example, names such as "cOST Extender," "cOST Process Mapper," "Indexer for cOST," "cOS Extension," and any name that encompasses a trademark of Net.Orange or an offering name of Net.Orange, including Net.Orange cOS, are strictly prohibited.

Do not state or imply that your product is produced or authorized by Net.Orange. For example, do not represent your training programs as "authorized Net.Orange training."

When you describe product compatibility, you may refer to an Net.Orange offering name but never solely to compatibility with "Net.Orange."

Incorrect example:
<Your company name> <your product name> for Net.Orange

Correct example:
<Your company name> <your product name> for use with Net.Orange cOS™

When referring to an Net.Orange offering name, please use the complete, correct Net.Orange offering name. Refer to the selection of Net.Orange offering names within this guide or contact your Net.Orange partner manager for information.

Incorrect example:
Our product runs with cOST.

Correct example:
Our product runs with cOST Imaging.

Compatibility References within Running Text

In text sentences, you may use phrases such as the following to refer to your offering's compatibility with Net.Orange software:

  • "for use with..."
  • "designed for use with..."
  • "runs on..."
  • "compatible with..."

However, you must take care to use them appropriately, as demonstrated in the following examples.

Correct examples:
<Your company name> <your product name> is designed for use with Net.Orange™ cOS™.
<Your company name> <your product name> is compatible with Net.Orange™ cOS™.

Do not use any grammatical construction that implies the Net.Orange trademark or Net.Orange offering name is part of your offering's name.

Unacceptable example:
<Your company name> <your product name> for cOST Imaging provides extended functionality.

The above example is unacceptable because the reader could interpret your product name to be "<Your product name> for cOST Imaging." Change any such construction to clearly separate and distinguish your offering name from the Net.Orange trademark.

Corrected example:
<Your company name> <your product name> provides extended functionality for users of Net.OrangeT Imaging.

Compatibility References within Headlines, Signage, Packaging, Labels, and Other Materials

It is particularly important to avoid making your product name appear to include an Net.Orange trademark or an Net.Orange offering name when the reference is in a title or headline, trade show signage, product packaging, CD label, or any other material.

Within headlines, signage, and other materials, you may use phrases such as the following to refer to your offering's compatibility with Net.Orange software:

  • "for..."
  • "for use with..."
  • "designed for use with..."
  • "runs on..."
  • "compatible with..."

However, you must always clearly visually differentiate your product name from the compatibility reference to an Net.Orange offering.

Unacceptable examples:
<Your company name> <your product name> for cOST Imaging
<Your company name> <your product name> for Use with cOST Imaging

To correct this, use a type size for the Net.Orange offering name that is noticeably smaller than the type size for your offering name. Or use a different font or a different style, such as italics, for the Net.Orange name.

Corrected examples:
<Your company name> <your product name> for cOST Imaging
<Your company name> <your product name> for Use with cOST Imaging

The above examples are acceptable because your product name and the compatibility references "for cOST Imaging" and "for Use with cOST Imaging" are visually set apart.

Another option would be to place your product name in the title and to show the compatibility reference as a subtitle in a different type size, font, or style.

Example:
<Your company name> <your product name> for cOST Imaging

Self-Test for Avoiding Unacceptable Practices

Consider the following questions to determine if a particular product or service name, compatibility reference, marketing communication, or packaging may pose a problem to Net.Orange and its trademarks:

  • Does your product or service name include an Net.Orange trademark or an Net.Orange offering name or similar variations of these?
  • Do you use an Net.Orange trademark or an Net.Orange offering name in a way that gives the impression that the Net.Orange trademark or Net.Orange offering name is part of your product or service name?
  • Do you use just the term "for Net.Orange" to refer to product compatibility?
  • Does your offering name, or the usage in question, lead anyone to believe your offering is developed, endorsed, or authorized by Net.Orange?
  • Does your communication material show any logos of Net.Orange (or variations of them) other than your permitted Net.Orange Partner logo, your permitted Net.Orange Certified Integration logo, or your permitted "Powered by Net.Orange " endorsement logo?

If the answer to any of these questions is "Yes," then you should change your product or service name, the compatibility reference, your marketing communication, or packaging to reflect proper usage.

Using the Phrase "Powered by"

Only use the phrase "powered by" in the "Powered by Net.Orange" context. Do not use "powered by" to describe compatibility with other Net.Orange offerings.

Incorrect example:
<Your company name> <your product name> is powered by cOST Imaging.
